Note to General Austin: Don’t mess with Texas.
Austin undoubtedly contributed to the disastrous Afghanistan withdrawal, one of the most humiliating defeats of all time, which is precisely why he is woefully unprepared to take on Governor Abbott.
Particularly when Abbott is on the side of liberty, not to mention the law.
While Austin proclaimed that all military branches must be fully vaccinated several months ago, he apparently did not realize that his word alone does not constitute the law.
After all, contrary to Democrats’ dreams, the United States is still the land of the free … for now.
It certainly has a higher chance of remaining land of the free for all with leaders like Governor Greg Abbott in charge, who basically told General Austin to take his mandate elsewhere when it comes to the Lone Star State.
“As Governor of Texas, I am the commander-in-chief of this State’s militia … In that capacity, on October 4, 2021, I ordered the Adjutant General of Texas to comply with my Executive Order GA-39.” [Source: Fox News]
Executive Order GA-39 refers directly to the prohibition of vaccine mandates, directly challenging General Austin’s unlawful order. The text of the executive order is explicit, as well as aligned with basic principles of freedom and liberty.
“No governmental entity can compel any individual to receive a COVID-19 vaccine. I hereby suspend Section 81.082(f)(1) of the Texas Health and Safety Code, and any other relevant statues, to the extent necessary to ensure that no governmental entity can compel any individual to receive a COVID-19 vaccine …
State agencies and political subdivisions shall not adopt or enforce any order, ordinance, policy, regulation, rule, or similar measure that requires an individual to provide, as a condition of receiving any service or entering any place, documentation regarding the individual’s vaccination status for any COVID-19 vaccine.” [Source: Government of Texas]
Hey, aren’t the Democrats all about “my body, my choice?” Looks like they may need to amend that little slogan in the future …
Abbott also pointed out that any adverse consequence endured by any guardsman is entirely due to the overly zealous Biden administration, which has apparently abandoned any semblance of adherence to checks and balances.
“If unvaccinated guardsmen suffer any adverse consequences within the State of Texas, they will have only President Biden and his Administration to blame …
The State of Texas will not enforce this latest COVID-19 vaccine mandate against its guardsmen. If the federal government keeps threatening to defund the Texas National Guard, I will deploy every legal tool available to me as Governor in defense of these American heroes.” [Source: Fox News]
So, it remains to be seen if General Austin will punish true American heroes, though if he were remotely reasonable, he should probably back down.
Especially after destroying his credibility over Afghanistan.
Abbott also scored another triumph against the Biden administration, namely when Texas Attorney General Ken Paxton succeeded in obtaining an injunction to block more invasive mandates.
Even better, Abbott and Paxton’s victory also represents a victory for Trump, given that Trump was the only who wisely appointed Judge Matthew J. Kacsmaryk, who called out the Biden administration for its disregard of checks and balances.
You know, the same issue that Democrats accused Trump of (hilarious, isn’t it?)
Kacsmaryk’s ruling was rather clear on the authoritarian Biden state, as his written decision left no ambiguity.
“A federal agency has no power to act absent Congressional power conferring it such authority …
The APA requires courts to ‘hold unlawful and set aside agency action’ found to be ‘in excess of statutory jurisdiction, authority, or limitations, or short of statutory right.’ 5 U.S.C. § 706(2)(A), (C). Therefore, ‘to permit an agency to expand its power in the face of a congressional limitation on its jurisdiction would be to grant the agency power to override Congress.” [Source: Fox News]
So, the President of “Unity” wants to disempower Congress. Nice (not).
One can only hope that the judges keep holding down the fort until the 2022 midterm elections …
Of course, Biden may well be disregarding checks and balances now because he likely knows he’s in for a shellacking come midterms … so of course he wouldn’t want to work with a Republican-majority Congress.
Heck, he apparently doesn’t even work with a Democrat-majority Congress …
